1. Introduction & Scope

These Terms & Conditions (“Terms”) govern the use of services (“Services”) made available via THOOIMAI VAHANSERVICES, including the website www.thooimaivahan.com, the mobile application, and any associated digital or physical channels (collectively the “Platform”). By accessing or using the Platform, you agree to be legally bound by these Terms, including the Privacy Policy and any supplemental policies we may publish.

2. Eligibility & Account Registration

For Customers: Services are available only for vehicle owners or authorized users within our designated operational zones or residential communities.[1]
Each individual or entity can register only one account; use of multiple accounts is prohibited.
You are responsible for providing and maintaining accurate, current information.

3. Services Coverage

We provide scheduled or on-demand car washing and grooming at the vehicle’s parking location as per your chosen subscription or booking plan, subject to our staff availability and your address/service zone.
Service specifics and methods will be as detailed in your subscription or booking confirmation; temporary limitations (e.g., holidays, weather, special advisories) may apply.

4. Account Security & Communications

Protect your login credentials and do not share access to your account.
You agree to receive SMS, push notifications, email updates, and phone calls relating to bookings, payments, and essential service matters. Marketing communications may be opted out per your preference.
Breach of your account security should be reported immediately.

 

 

5. Payments & Subscription Plans

Services are prepaid (subscription or one-time). Subscriptions auto-renew unless cancelled before the renewal date.
Accepted payment methods: UPI, card, wallets, net banking, or as specified on the Platform.
All fees/taxes as required by law are included in your service charges.

6. Cancellations & Refunds

Customers: Cancellations must follow instructions on the platform or be communicated via email/phone. For monthly plans, cancel at least 3 days before renewal.
Refunds are processed ONLY when we fail to deliver service due to our fault or in case of billing/payment error; no refund for user unavailability, inaccessible/locked vehicles, voluntary skips, or mid-cycle cancellation.
Processing period: Approved refunds will be made to the original payment method within 7–10 business days.
Platform: We reserve the right to forfeit payments/credits in cases of misuse, fraud, repetitive cancellations, or abuse.

7. User/Customer Responsibilities

Make your vehicle accessible and remove valuables prior to service appointment.
Any misuse, unlawful activity, or attempt to bypass the Platform procedures/booking will result in account suspension or termination and may forfeit pending payments or deposits.

8. Service Partner/Staff Responsibilities

All service professionals must comply with professional, courteous behavior, operate only via the Platform (no off-platform/freelance bookings), and use only approved equipment/materials.
For safety and trust, partners may not delegate work to others unless specifically authorized and on-boarded through the company/process.
Background checks, orientation, and retraining may be required; non-compliance may result in suspension or termination and forfeiture of security deposits.
Partners are responsible for maintaining high service standards; repeated complaints, low ratings, or contract breach can result in deactivation.

9. Limitation of Liability

For customers: Our liability is limited to refunding the amount paid for the wash/booking cycle in question; we are not liable for pre-existing damage, water marks, or minor scratches.
We are not liable for indirect, incidental, nor consequential damages except as required by Indian law.

10. Intellectual Property

All content (logos, graphics, UI, platform code, SOPs, documentation) remains the property of [Your Company Name] or authorized licensors.
No unauthorized reproduction, distribution, or reverse engineering is permitted.

11. Privacy & Data Protection

We collect only necessary information (contact details, address, payment data, usage logs, etc.) to facilitate services and improve performance.
Data may be shared with staff, payment processors, or legal authorities, but it is not sold to third parties for marketing. For more, see the detailed Privacy Policy.
Industry-standard measures (encryption, access control) are used to protect data; however, no system is 100% secure.
Users may request access, correction, or deletion of their data, and may opt out of non-essential communication.
Cookies may be used for analytics and preferences and can be managed via browser settings.

12. Termination, Suspension & Right to Refuse

We reserve the right to suspend or terminate your account/subscription for breach of these Terms, non-payment, fraud, or misuse, at our sole discretion.
Upon termination, pending settlements (service credits, deposits, pending wages, etc.) will be processed after legal and company deductions as applicable.

 

13. Dispute Resolution, Governing Law & Jurisdiction

Our services and these Terms are governed by Indian law.
Any disputes or complaints should be raised via registered email, platform helpdesk, or in-person at our office.
We encourage resolution via mediation first; unresolved disputes will be settled by arbitration as per the Arbitration and Conciliation Act, 1996. Jurisdiction is [Your City/State], India.

14. Updates to Terms

These Terms may be updated periodically. Notice will be posted on the Platform. Continued use indicates your explicit acceptance of the revised terms.
